1. Overview

This website, roehaina.com, is operated by Roehaina ("Roehaina," "we," "us," "our"). By visiting our site or buying from us, you agree to these Terms of Service, our Refund Policy, Shipping Policy and Privacy Policy. If you do not agree, please do not use the site.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm the information you provide is accurate and that you are authorized to use the payment method.

3. Products and descriptions

We do our best to show our products, colors and measurements accurately. Colors can look different on different screens, and handmade fill and foam products can vary slightly in size, weight and loft (within about 5%). We do not warrant that every description is error-free; if a product is not as described, your remedy is to return it under our Refund Policy.

4. Not medical advice

Roehaina pillows and bedding are comfort products. They are not medical devices and are not intended to diagnose, treat, cure or prevent any condition. Statements about comfort, support, alignment or sleep are general and individual results vary. Customer reviews reflect personal experiences only. If you have neck, back or sleep problems, talk to a healthcare professional.

5. Prices and promotions

All prices are in US dollars and may change at any time without notice. Compare-at prices reflect our regular or suggested retail price. Sale prices, countdowns and discount codes (including welcome codes) are valid only for the period stated, are limited to one code per order unless stated otherwise, cannot be exchanged for cash, and may be withdrawn at any time. We are not obligated to honor prices that are clearly an error.

6. Orders and payment

Your order is an offer to buy. We may accept or decline it, limit quantities, or cancel it (for example, because of a pricing error, suspected fraud, or stock issues). If we cancel after you have been charged, we will refund you in full. Payments are processed securely by Shopify and its payment partners; we never see or store your full card number. Applicable sales tax is calculated at checkout.

7. Shipping, risk and title

We ship within the United States as described in our Shipping Policy. Title and risk of loss pass to you when the carrier delivers your order.

8. Returns and warranty

Returns, refunds, the 30-night sleep trial and our 1-year limited warranty are covered in our Refund Policy. Except for that limited warranty, and to the fullest extent allowed by law, our products and this site are provided "as is" without other warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.

9. Intellectual property

All content on this site, including the Roehaina name and logo, text, product photos, graphics and site design, belongs to Roehaina or its licensors and is protected by law. You may not copy, reproduce or use it for commercial purposes without our written permission.

10. Reviews and submissions

If you send us a review, photo, video or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, edit and display it in connection with our business, including on our site and in ads. You confirm you own the content, it is truthful, and it does not violate anyone's rights. We may remove any content at our discretion.

11. Acceptable use

You agree not to use the site for anything unlawful, to interfere with its security or operation, to scrape or harvest data, to submit false information or fraudulent orders, or to abuse promotions (for example, creating multiple accounts to reuse a one-time code).

12. Third-party services

Our site uses third-party services such as Shopify, payment processors, shipping carriers and analytics or advertising tools. Your use of those services may be subject to their own terms. We are not responsible for third-party sites linked from ours.

13. Limitation of liability

To the fullest extent allowed by law, Roehaina and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or our products. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Some states do not allow these limits, so they may not fully apply to you.

14. Indemnification

You agree to indemnify and hold Roehaina harmless from claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the site.

15. Governing law and disputes

These Terms are governed by the laws of the State of Indiana, USA, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at hello@roehaina.com and try to resolve it informally for at least 30 days. Any claim that is not resolved will be brought in the state or federal courts located in Allen County, Indiana, and you consent to their jurisdiction. Nothing here prevents either party from bringing an individual claim in small claims court.
